CANCELLATION INSURANCE POLICY

CHAPTER -1-         OUR COVER

1.     Purpose of the cancellation insurance policy

If you cancel your trip, the tour operator will charge you all or part of the price of the cancelled services, called cancellation fees; these fees gradually increase as the departure date approaches. They are calculated according to a scale indicated in the general Terms and Conditions of the brochure.

Our cover consists of complementing the reimbursement of the tour operator, airline or rental organisation. We reimburse to you the cancellation fees that you contractually bear when you cancel your stay, before departure, for a valid reason under this agreement.

In the case of rentals, our cover is granted provided the rental has been fully cancelled.

Note:
All of the tourist services covered by this agreement, whether they run concurrently or successively, are deemed to form one and only one trip, for which only one departure date is set: the date specified by the tour operator as the starting date for the insured services.

2.     Events eligible for insurance cover

You are insured if you have to cancel your trip for one of the following reasons:

2.1        A serious illness or physical injury, including the after-effects, relapse, complications or aggravation of a disease or accident suffered before booking your trip, or the death of:

a)   Yourself, your legal or common-law spouse, an ascendant or descendant;

b)   A brother, sister, brother-in-law, sister-in-law, son-in-law, daughter-in-law or parent-in-law;

c)   A business partner covering for you, indicated at the time you subscribe to this insurance policy;

d)    The person designated when you subscribed to this agreement as being in charge, during your trip, of looking after or escorting your underaged child or children or a disabled dependant.

It is your responsibility to establish the real nature of the situation entitling you to this insurance cover. We thus reserve the right to reject your request, should the information provided fail to demonstrate material facts, according to our doctors.

2.2        Pregnancy complications.

2.3        Serious material damages following a burglary, fire, water damage or climatic event, affecting more than 50% of your main or second place of residence, making it compulsory for you to attend to the damages on the date you were due to depart, for the implementation of preventative measures and administrative procedures.

2.4        Serious material damages caused to your vehicle occurring within 48 hours prior to your departure and affecting your vehicle in such a way that you cannot use it to drive to the location of your stay.

2.5        The redundancy of yourself or your spouse, provided this procedure had not begun on the day you subscribed to this agreement.

2.6        Your appointment to a salaried job or paid internship, becoming effective before or during the scheduled dates of your trip, while you were unemployed, providing this appointment is neither a contract extension nor renewal, nor a temporary contract provided by a temporary employment agency.

2.7        The modification of your holiday dates by your employer. This guarantee is granted to salaried employees, and excludes self-employed people and company executives. These holidays must be a vested right and must have been previously approved by the employer. You will receive compensation minus a specific excess that is set in the Terms and Conditions, and which also applies to the persons who registered with you. This excess represents 25% of the total amount paid at the time of booking and applies to any cancellation occurring between 30 days and 1 day prior to departure.

2.8        Your non-disciplinary professional transfer, imposed by your employer, forcing you to relocate in the 8-day period before departure or during your insured trip, provided you were not aware of such a transfer at the time you subscribed to this agreement.

2.9        Your required attendance for adoption of a child during the insured trip, provided you were not aware of this notification at the time you subscribed to this agreement.

2.10        The cancellation for a valid reason by one or several of the persons who registered at the same time as you and were also insured under this agreement, if, because of this cancellation, you must travel alone or with just one other person.

CHAPTER -2-         COVER BENEFITS

2.1.         In no event will the compensation paid pursuant to this agreement exceed the amount of the fees charged by the trip organiser, following the contractual scale(s) and within the limits set out in the Terms and Conditions.

2.2.         We will reimburse to you the cancellation fees charged by the trip organiser according to the scale set in the organiser's Terms and Conditions. However, the reimbursement is limited to the fees you would have been charged following this scale if you had informed the organiser within 48 hours following the event covered by this guarantee. The administrative costs, gratuities, visa fees as well as the premium paid for subscription to this agreement are not refundable.

2.3.         A €38 excess covering the handling of your file is always deducted from the compensation payable.

CHAPTER -3-         CONDITIONS FOR THE APPLICATION OF THE INSURANCE COVER

3.1.         The insurance must be subscribed to and registered with Travelhorizon BV at the time you book the insured stay or at the latest before the cancellation fees scale specified in the organiser's Terms and Conditions becomes effective.

3.2.         The cover applies from the first day the cancellation fees scale becomes applicable, or on the day you subscribe to this agreement if such a subscription occurs subsequently, and stops immediately when the first insured service starts.

3.3.         The application of the cancellation insurance is not cumulative with any other cover subscribed to under this agreement.

CHAPTER -4-         REQUIREMENTS IN THE EVENT OF CANCELLATION

4.1.         You must inform the organiser of your trip of your cancellation by the fastest means possible (fax 0033 (0)4 42 970 980, email to service_client@travelhorizon.com, notification to the travel agency, registered mail with acknowledgement of receipt) as soon as a valid event preventing you from taking your trip occurs or within 48 hours following such an event.

Note:
If you fail to inform the organiser of your intention to cancel as soon as possible, you will only be covered for the cancellation fees contractually due when the event entitling you to our cover occurred, and you will be responsible for the difference.

4.2.         You must inform us of the event for which you are making a claim within five working days of becoming aware of the event, except for a fortuitous or force majeure event:

We will provide you with the necessary information to submit your claim.

Moreover, if you cancel because of a sickness or a physical injury, you will have to pass on to Travelhorizon BV's doctor all the necessary information and documents to assess the legitimacy of your claim.

CHAPTER -5-         COVER EXCLUSIONS

In addition to the general exclusions (Chapter 3 of the common terms), the following are also excluded from the cover:

5.1.         Sicknesses or accidents which were first observed or were subject to a treatment, relapse, aggravation or hospitalisation between the date the trip was booked and the subscription date of this agreement.

5.2.         Pregnancy, except for marked and unpredictable complications, voluntary termination of pregnancy, childbirth, in vitro fertilisation and its consequences.

5.3.         Failure to obtain any necessary vaccinations.

5.4.         Any medical event, the diagnosis, symptoms or cause of which is related to mental, psychological or psychiatric health, and which has not resulted in a hospitalisation of more than 5 consecutive days after the subscription of this agreement.

5.5.         Accidents resulting from the practice, as an amateur and at any level, of motorsports (car, motorbike or any motor vehicle) or aerial sports.

5.6.         Epidemics, pollution, acts of God, subject to the procedure under Law 82.600 of the 13th of July 1982 as well as their consequences.

5.7.         Consequences of penal procedures you are subject to.
